This documents your cancellation rights and the period of time within which you have to decided whether or not you wish to use Evans Halshaw Leasing’s brokerage service.
Please note, this policy specifically relates to cancelling our brokerage service and does not relate to your cancellation rights with the finance provider.
For regulated agreements that have been concluded without any face-to-face dealings (i.e., over the phone, email, internet etc.) you have the statutory right to cancel the contract without penalty and without giving any reason within 14 calendar days in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations. This legal right applies equally to all personal customers, sole traders, and partnerships with up to four partners.
For clarity, the 14-calendar day cancellation period for Evans Halshaw Leasing begins from when you sign and return your customer order form. This is determined as an ‘acceptance’ of an order. For orders cancelled after 14 calendar days, the following cancellation fees will apply:
If you cancel your order after the 14-calendar day period but before you sign your finance documents, a cancellation fee of £75 Inc. VAT will apply to cover all costs and expenses incurred in arranging the credit hire agreement up to that point.
If you cancel your order after the 14-calendar day and after you sign your finance documents, a cancellation fee of £150 Inc. VAT will apply to cover all costs and expenses incurred in arranging the credit hire agreement up to that point. We also reserve the right to pass on any additional cancellation charges levied by the supplying dealership should you cancel the vehicle order. We will inform you whether this applies at the point of the cancellation request
The above cancellation fees will become applicable once you have provided written confirmation you wish to cancel and are withdrawing from using our services. This will be payable via BACS or credit/debit card and must be paid within 14 working days of the point at which the cancellation is confirmed.
A Processing Fee is the fee specified on all quotes and order forms. This fee is for our initial services such as; sourcing a finance offer and ordering your chosen vehicle from the supplier who has provided an anticipated delivery date. This fee is paid at the point of order and is not refundable unless we are unable to source any vehicle that matches your order confirmation. Orders can only be placed with suppliers when signed order forms are returned and processing fee's received. Evans Halshaw Leasing cannot be held responsible for changes in delivery timescales from initial quotation and orders being confirmed as this is out of our control.
For non-regulated agreements (Limited Companies, Limited Liability Partnerships (LLP), and Partnerships with more than four partners) that are cancelled following the ‘acceptance’ of an order (once a customer order form is signed and returned), Evans Halshaw Leasing will charge a cancellation fee of £150 Inc. VAT. This fee will become applicable once you have provided written confirmation you wish to cancel and are withdrawing from using our services. This will be payable via BACS or credit/debit card and must be paid within 14 working days of the point at which the cancellation is confirmed.
If you wish to exercise your right to cancel, you must notify Evans Halshaw Leasing of your decision to cancel the contract in writing by post or via email to:

Your full name
Your full address
The details of your order (i.e., full vehicle description)
You do not have to give a reason for your cancellation.
Upon receipt of your cancellation, we will write to you to confirm any cancellation fees that will apply should you wish to withdraw. You will be required to provide written consent that you agree to these terms.
Please note, by exercising your right to cancel, you are withdrawing from your brokerage agreement with Evans Halshaw Leasing and the contract is terminated.
You will be required to pay any cancellation fees within 14 working days from the point your cancellation is confirmed (i.e., you have exercised your right to cancel and given written consent that you have acknowledged the cancellation fee).
